Trips
Definition
1.1 Splash Maldives: Refers to the team responsible for organizing the contracted Splash Trip, including any individual or third party engaged by Splash Maldives to assist in delivering the Trip.
1.2 Participant: Refers to the individual for whom Splash Maldives has agreed to provide the Trip. Restrictions may apply depending on the age, physical condition, or other factors. Participants are encouraged to contact Splash Maldives in case of doubt or clarification.
1.3 Trip: Refers to the Maldives trip organized by Splash Maldives, as outlined in the Trip Programme.
1.4 Trip Cost: Refers to the total price of the Trip, as specified in the Trip Programme.
Liability
2.1 Service Standard: Splash Maldives will organize and provide the Trip with reasonable skill and care.
2.2 Third-Party Providers: Where parts of the Trip are arranged through third-party providers, Splash Maldives will exercise reasonable skill and care in their selection. However, Splash Maldives shall not be liable for the performance, negligence, or actions of third-party providers or for any loss or damage caused to the Participant or their possessions by such parties.
2.3 Inherent Risks: Participants acknowledge and accept the inherent risks associated with the Trip, including activities related to ocean-based travel, diving, snorkeling and other excursions.
2.4 Assumption of Risk: The Participant participates in the Trip entirely at their own risk. Splash Maldives shall not be liable for any loss of profit, consequential loss, or other damages, whether caused by Splash Maldives or third-party providers.
2.5 External Factors: Splash Maldives does not guarantee the success or outcomes of the Trip, as these may depend on factors beyond its control, such as weather or sea conditions.
2.6 Delays and Cancellations: Splash Maldives shall not be held liable for delays, cancellations, or damage to the Participant’s property arising from circumstances beyond its control.
2.7 Liability Limitation: The liability of Splash Maldives to the Participant is strictly limited to the value of the Trip Cost.
Insurance
3.1 Mandatory Insurance: Participants are required to obtain comprehensive travel insurance at their own expense to cover all risks associated with the Trip. A copy of the insurance policy must be provided to Splash Maldives as proof.
3.2 Cancellation Insurance: Participants are strongly advised to secure cancellation insurance at the time of paying the deposit.
3.3 Participant Responsibility: It is the Participant’s sole responsibility to ensure their insurance covers all potential risks and requirements for the Splash Trip.
Payments
4.1 Trip Cost: Participants are required to pay the full Trip Cost to Splash Maldives.
4.2 Deposit: A deposit of 40% of the Trip Cost is required at the time of booking. Splash Maldives will confirm availability prior to deposit payment.
4.3 Cost Adjustments: Splash Trip Costs may be subject to variation due to factors such as fuel price fluctuations exceeding ±10%. Splash Maldives reserves the right to amend the cost accordingly.
4.4 Final Balance: The remaining balance of the Trip Cost is payable upon arrival.
Cancellation Policy
5.1 Participant Cancellation:
(i) Participants must provide written notice of cancellation or withdrawal via email or WhatsApp.
(ii) Deposits are non-refundable under any circumstances. However, Splash Maldives may, at its discretion, provide a voucher equivalent to the deposit amount for future use, depending on the circumstances.
Other Terms and Conditions
6.1 Itinerary Changes: Splash Maldives reserves the right to make changes to the itinerary if deemed necessary for any reason, including safety, weather, or operational constraints.
6.2 Entire Agreement: These terms and conditions, along with the signed disclaimer, constitute the entire agreement between the Participant and Splash Maldives. Any changes to these terms must be agreed upon in writing.
6.3 Severability: If any clause in these terms and conditions is found to be unenforceable, the remaining provisions will continue to apply.
6.4 Governing Law and Jurisdiction: All services provided by Splash Maldives are offered exclusively in the Maldives. The applicable law is Maldivian law, and any disputes shall be subject to the exclusive jurisdiction of the Maldives courts.
By participating in the Trip, the Participant acknowledges that they have read, understood, and agreed to these Terms and Conditions.
